Rain Water Tank Conditions

The following will apply to all applications to install a tank:
1. The water tank will not be connected to the Unit’s municipal water supply. Refer to BCM Water Bylaws Clause 33.
2. Maximum tank capacity is 5000 litres.
3. The supplier’s brochure, showing all full details of the tank to be installed, must be attached to the application. This must include specification of the tank i.e. its capacity, dimensions, material of construction, colour.
4. Only the following colours for the tank are acceptable:
a. Settlers Village - Beige.
b. Settlers Rest Village -
c. The colour must be clearly indicated on the application and quotation.
5. The colour of the piping from the gutter that feeds rain water into the tank must blend in with the existing gutter installation.
6. The costs associated with the installation of the tank, including any changes to the gutters and down-pipes, will be for the owner’s account.
7. The installation must include an overflow pipe from the tank to the ground, of an adequate capacity to carry all overflow from the catchment gutter.
8. The discharge from the overflow pipe must be directed away from the cottage and must discharge in the same direction as the natural flow of storm water in the area of the installation.
9. Under no circumstances may the overflow pipe be discharged into the unit’s waste water system.
10. Any damage caused to common property or any other unit during the installation of the tank or the changes required to the gutters and downpipes will be for the owner’s account.

Recommendation:
It is strongly recommended that a “First-flush” silt filter be installed to reduce the build-up of silt and sediment in the water tank. It is simpler to maintain than cleaning out silt and sediment inside the tank.

If the application is for a tank located in the unit’s courtyard, the following conditions also apply:
1. The top of the tank must not protrude excessively above the courtyard wall.
2. The courtyard floor must be certified as strong enough to bear the additional weight with no adverse effects on the floor or surrounding structures.
3. The majority of the applicant’s immediate neighbours must agree in writing that they do not have any objections to this application being approved; these documents must be submitted with this application.
4. A “to scale” plan of the proposed installation must be attached to the application. This must clearly indicate the exact position where the tank will be located.
5. The details for all changes to gutters and downpipes must be shown on an elevation view drawing or a suitable photograph shall be provided.

If the application is for a tank located on common property, the following conditions also apply:
1. The tank must be positioned adjacent to one of the unit’s exterior walls.
2. The tank must be placed on a suitable base, complying with the following specifications:
a. The base dimensions must be at least the same area as the water tank and no part of the tank may extend beyond the edge of the base.
b. The base must be made of concrete, without metal reinforcing. The concrete must be of the correct consistency and laid by a qualified builder. It can have a face-brick surround.
c. The foundation depth below ground level must be a minimum of:
i. 100mm for tanks up to 1000 litres capacity
ii. 150mm for tanks between 1000 and 1500 litres
iii. 200mm for tanks between 1500 and 5000 litres.
3. Foundations to be inspected before building commences.
4. The majority of the applicant’s immediate neighbours must agree in writing that they do not have any objections to this application being approved; these documents must be submitted with this application.
5. A “to scale” plan of the proposed installation must be attached to the application. This must clearly indicate the exact position on common property where the tank will be located.
6. The details for all changes to gutters and downpipes must be shown on an elevation view drawing or a suitable photograph shall be provided.

General Terms & Conditions applicable to this application

1. Application for any change to the Section is to be made in writing.
2. The Trustees reserve the right to decline any application.
3. No work may commence before an application has been approved in writing.
4. The application must include a site plan of the unit clearly showing the proposed positioning of the installation/change in relation to the unit, road and neighbouring units.
5. A written quotation for the work must accompany the application.
6. The installer must be a reputable company with staff qualified to do the work.
7. Specifications for the installation/change must be included in the submission and must conform to the laid down requirements in the Village. If possible and relevant, a colour brochure from the supplier and/or photographs must be included with the specification.
8. The applicant understands that if the completed installation/change does not conform to the specifications approved in this application, the Trustees can issue an instruction to make it compliant, or for the removal of the structure and reinstatement of the unit to its original state at the owner’s cost.
9. Even if the installation/change will be installed on common property, the applicant undertakes to continue to maintain the installation/change at their own cost and the Trustees reserve the right to take any action that may be necessary if this is not done.
10. Any damage to the existing structure or common property caused by the installation, or attributable at a later stage to the existence of the installation, must be immediately repaired by the owner, at their cost.
11. The conditions and obligations of this application must be accepted in writing by any future purchaser of the Section before the Clearance Certificate is issued by the Trustees.

Insurance

Water tanks are automatically covered by the Body Corporate insurance policy, up to a value specified in the Policy Wording.
It is the owner’s responsibility to ensure that the tank being installed is within the specified value. A premium to cover the amount by which the tank exceeds the specified value is for the owner’s account.
In the case of a claim, the First Amount Payable is for the owner’s account.
